According to Minnesota Statutes section 573.02, a “wrongful death” is a death that is “caused by the wrongful act or omission of any person or corporation.” That “wrongful act” can be intentional or negligent. The family of the person killed by the wrongful act, by a trustee, must file the case on the deceased’s person’s behalf. A trustee is appointed by a judge and sues for compensation on behalf of the heirs, or next of kin, of the deceased person. The next of kin of a deceased person generally includes their spouse, children, parents, grandparents, aunts and uncles, nieces and nephews and cousins.

The types of compensation sought can include things like:

  • Funeral expenses
  • Loss of income and/or benefits
  • Expenses related to any medical care the deceased received to treat their injuries/illness prior to death
  • Loss of services, protection, care and assistance to the deceased’s family, sorrow and mental anguish
  • Loss of society/companionship, among others
