Our Approach
Divorce/Family law covers a variety of areas including divorce, paternity, child custody, parenting time, child support, spousal maintenance, adoption, and domestic abuse. We understand that family is one of the most important parts of your life, and we will zealously advocate for you and your children.
If you are going through a divorce, the process will start with one party serving the other party with a Summons and Petition. If you are the party that was served, then you should contact us immediately as you are required to respond within 30 days or the other party may request the matter proceed by default. If the divorce proceeds by default the Court will likely award the party who served the Summons and Petition what he/she requested without any input from the party that failed to respond.
After the initial documentation is filed with the Court by both parties, then the Court will schedule an Initial Case Management Conference which both parties attend with their attorneys. At this stage, the Court encourages the parties to attempt settlement by participating in an Early Neutral Evaluation. The goal of the Early Neutral Evaluation, which is attended by parties and attorneys, is to reach an agreement between the parties after receiving feedback from evaluators regarding how a judge may decide their case.
The Court would prefer parents reach agreements in Divorce/Family law matters, especially matters regarding custody and parenting time. The general consensus is that it is in the best interest of the children, and the parents will be more successful at co-parenting, if the parents are able to reach an agreement regarding the children. However, not all parties are able to reach agreements, and then we will fight for you and your children in Court.
